The .locus top-level domain is owned and created by Locus (the Company) and operated by Tyemill (the Developer). The website maps.locus, any other websites or services provided on .locus, and any content made available to you are collectively referred to as Locus.

By using Locus, you agree to be bound by these terms of service and any future terms (collectively, Terms). Please read the terms carefully and review them on an ongoing basis. If you do not agree to the Terms, you may not access, use, or link to Locus.

If you are using Locus on behalf of an organization, you agree to be bound by the Terms on behalf of yourself and such organization, and represent you have the authority to agree to such terms on behalf of the organization. Any terms and conditions proposed by you that conflict with or add to those in this agreement are expressly rejected by the Company and shall have no force and effect.

The maps.locus site is for demonstration purposes only. Use of the site for commercial or for-profit purposes is prohibited. Your use of the site may be monitored, and the resultant information may be used by the Company or the Developer for business purposes or in accordance with any applicable legal requirements or the requirements of a regulatory organization.

Unauthorized use of Locus, including, but not limited to, unauthorized entry into the Company or the Developer's systems, misuse of passwords, or misuse of any other information, is strictly prohibited. You may not use the site in any way that could damage, impair, overburden, or disable Locus or interfere with other party's use and enjoyment of the site. You may not use any system or software to extract data from the site.

The information on Locus may contain inaccuracies. The Company and the Developer reserve the right, without any obligation, notice, right, or reason, to change, improve, or correct the information and to suspend or deny access to Locus for scheduled or unscheduled maintenance, upgrades, corrections, or otherwise. The Company or the Developer may change any product, service, information, or material on Locus at any time.

These terms of use are not intended to, and will not, transfer or grant any rights in or to the material available on Locus other than those specifically described herein. All rights not expressly granted herein are reserved by the Company or the third party providers from whom the Company has obtained information or materials.

The geographic maps are provided using technology from the Google Maps API. By using Locus, you agree to abide by the Google Maps API terms of service (Google TOS), found at https://developers.google.com/maps/terms. If you do not consent to and abide by Google TOS, you may not use Locus.

You agree that you will not engage in any activities on Locus that are contrary to any applicable laws and regulations.

Disclaimer of Warranties

No warranty as to content: although The Company and the Developer shall obtain information for inclusion in Locus that is considered reliable, Locus is provided as is, and neither The Company, any of its affiliates, nor any of its information providers, nor the Developer, any third party involved in Locus (collectively, the Locus Parties) make any representation or warranty of any kind to any licenses or third party, either express or implied, with respect to Locus, the timeliness thereof, the results to be obtained thereof, nor any other matter. The Locus Parties expressly disclaim, and licensee waives, any and all implied warranties, including, without limitation, warranties of originality, accuracy, completeness, timeliness, non-infringement, security, merchantability and fitness for a particular purpose.

No Liability for Content; No Liability Arising from Use: Although the information provided to you on this web site is obtained or compiled from sources we believe to be reliable, the Locus Parties cannot and do not guarantee the accuracy, validity, timeliness or completeness of any information or data made available to you for any particular purpose. Map data and related content are provided for demonstration purposes only. You may find that events may cause the actual information to differ from the information displayed on the map. You should exercise judgment in your use of all content made available by or through Locus. Map data and related content should not be used for navigation purposes of any type.

None of the Locus Parties, nor any of their affiliates, directors, officers or employees, nor their successors or assigns, nor any third-party provider, will be liable or have any responsibility of any kind for any loss or damage that you incur, arising from any failure or interruption of this web site, or resulting from the act or omission of any other party involved in making this web site, the data contained herein or the products or services offered on this web site available to you, or from any other cause relating to your access to, inability to access, or use of the web site or the data contained herein, whether or not the circumstances giving rise to such cause may have been within the control of the Locus Parties or of any vendor providing software, data, or services. Indemnification

Termination

You agree that, without notice, the Company may terminate these terms of use, or suspend your access to Locus with or without cause at any time and effective immediately, subject to any applicable law or regulation. These terms of use will terminate immediately without notice from the Company if you, in the Company’s sole discretion, fail to comply with any provision of these terms of use or with any applicable law or regulation. Upon such termination, you must discontinue your use of Locus and promptly destroy all materials obtained via Locus and any copies thereof.

If you are a copyright owner or an agent thereof, and believe that any user submission or other Company content infringes upon your copyrights, you may submit a notification pursuant to the Digital Millennium Copyright Act (“DMCA”) by providing our Copyright Agent with the following information in writing:

Choice of Law; Jurisdiction; Waiver of Jury Trial

These terms of use shall be governed by and construed in accordance with the laws of the State of New York, without regard to conflicts of laws provisions. Sole and exclusive jurisdiction for any suit, action or proceeding arising out of or related to these terms of use shall be in an appropriate state or federal court located in the County of New York, State of New York, and the parties irrevocably waive any objection they may now or hereafter have to the laying of venue of any such suit, action or proceedings in such a court, and irrevocably waive any claim that any such suit, action or proceeding brought in such a court has been brought in an inconvenient forum.

The parties unconditionally waive their respective rights to a jury trial. Any cause of action you may have arising out of your use of this site must be commenced within one (1) year after the claim or cause of action arises. If for any reason a court of competent jurisdiction finds any provision of these terms of use to be unenforceable, that provision shall be enforced to the maximum extent permissible so as to effect the intent of these terms of use, and the remainder of the terms of use shall continue in full force and effect. The terms of use constitute the terms between the Company and you arising out of this site and it supersedes all prior or contemporaneous communications, agreements and understandings between the Company and you arising out of the subject matter hereof. A printed version of these terms of use shall be admissible in judicial or administrative proceedings.
